Terms of Service

These Terms of Service ("Terms") govern your access to and use of Franchismo, a franchise intelligence platform operated by AwareGTM, Inc. ("Franchismo," "we," or "us"). By creating an account, subscribing, or using our services, you agree to these Terms.

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use after changes constitutes acceptance.

You must be at least 18 years old and authorized to bind your organization. Franchismo is designed for B2B use — vendors, lenders, agencies, M&A firms, and franchisors. You may not use the platform for unlawful purposes, harassment, or spam.

You may sign up for a free account or purchase a subscription. Subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for recurring fees until you cancel.

You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately of unauthorized access. You may not share a single-user login across multiple individuals.

Subject to your subscription tier, we grant you a limited, non-exclusive, non-transferable license to access and export franchise data for your internal business purposes. This license does not grant ownership of the underlying data.

You may not:

• Resell, redistribute, or publicly display our raw dataset
• Use the data to build a competing product or database
• Scrape, crawl, or systematically extract data outside our API or export features
• Use contact information for unsolicited marketing in violation of CAN-SPAM, GDPR, or similar laws
• Attempt to circumvent access controls or rate limits

Franchismo and its content, trademarks, logos, and software are owned by AwareGTM, Inc. and protected by intellectual property laws. You receive no rights beyond the limited license described above.

Feedback you provide may be used without restriction or compensation.

Franchismo is provided "as is" without warranties of any kind. We compile data from public sources and strive for accuracy, but we do not guarantee completeness, timeliness, or that contact information remains current.

You are responsible for complying with all applicable laws in your use of the data, including data protection regulations and telemarketing rules.

To the maximum extent permitted by law, AwareGTM, Inc. shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of Franchismo. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We may suspend or terminate your account for violations of these Terms or fraudulent activity.

Upon termination, your license to access paid data expires. Provisions related to data use restrictions, intellectual property, disclaimers, and liability survive termination.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts located in San Francisco County, California.
